  Perhaps.  But under US and International copyright law, it is still illegal
to do so.  Technically, they can still sue...  However, you are right.  In
that case, it is most likely that they won't care.

  Technically, you're not supposed to tape a movie or TV show off the air.
However, when was the last time you heard of someone getting charged with
copyright violations for taping the monday night mystery movie?  Or taping a
football game that they were unable to watch?
