If microsoft no longer sells the program and has droped support for it
totally then there is no monitary damages or loss of business as the result
of someone making themselves a single copy. There is not a court or a judge
in this country that will not throw that one out. $50,000 fine, jail...
get real there is no jail time for copyright infringment, and financial
awards are based on microsofts documented loses!
The documented loses on an unsupported product that the authors/publishers
do not feel is profitable enough to sell any longer would be nill. Unless of
course you started to mass-distribute it, in which case if you can find the
customers, then I am sure mickeysoft will be happy to licence it to you for
resale. Microsoft is not going to re-market a dead language just for a few
sysops, who are stuck in the dark-ages with VBBS. and they are not g oing to
pay their $250 per hour lawyers to chase down a few single copies of a $69
dead product. The reason magizines "Sell" reprints forever, is to preserve
their copyright, because you can not infringe on an expired copyright, it is
common to copy "out of print" books and documents when they are no longer
avai lable from the author or publisher.
As for your example: Like Ford is going to chase down used car thieves. If
you steal a 65 mustang there is going to be an angry X-mustang owner looking
for you, but it is not going to be FORD!
